Guide to EU Family Member Residence Card in Spain

eu family member card

The European Union's principle of free movement is one of its most significant pillars. For those looking to settle in Spain with a family member who is an EU, EEA, or Swiss national, the tarjeta de residencia de familiar de ciudadano de la unión (commonly known as the "Community Card" or "EU Family Member Card") is the essential legal document.

This comprehensive guide explores every facet of this residency permit, from the initial application to long-term permanent status.

What is the community card?

The tarjeta comunitaria, formally known as the residence card for a family member of a Union citizen, is the legal identity document that allows non-EU nationals to reside and work in Spain under the same conditions as Spanish citizens.

This document is an extension of the derecho de residencia (right of residence) held by the Union citizen. Under Royal Decree 240/2007, the lfree movement of family units is guaranteed. This right does not stem from a discretionary grant by the state but from the European Economic Area agreement and EU treaties that aim to prevent families from being separated by bureaucratic borders. Maintaining residence in Spain through this route is highly advantageous, as it grants an automatic work permit for both employed and self-employed activities.

Who qualifies as a family member?

Not any member of a family can apply for this permit. Spanish law is specific about who qualifies under the figure of a familiar de ciudadano (family member of a citizen). To be considered a Community family member, the applicant must belong to one of the following categories linked to a citizen of Spain or another member state of the EU/EEA:

Spouse or registered partner

The cónyuge o pareja registrada (spouse or registered partner) is the primary beneficiary. This includes legal marriages provided there has been no annulment or divorce. Likewise, a pareja de hecho (de facto partner) registered in a public registry of an EU/EEA member state holds the same rights.

Descendants and ascendants

  • Children: Descendants of the Union citizen or their partner who are under 21 years of age. If they are over 21, they must prove they live "at their expense" (financial dependency).
  • Parents: Direct ascendants of the Union citizen or their partner who are financial dependents.

Extended family

A family member who does not fit into the above categories (such as siblings, aunts/uncles, or cousins) may qualify if severe financial dependence or serious health reasons are proven, under the legal concept of "extended family."

What are the requirements for the card?

To obtain this permit, specific requirements for the card must be met to ensure the family unit does not become a burden on Spain's social assistance system.

Union citizen: the sponsor

The Community citizen must first possess their certificado de registro (registration certificate, often called the "green NIE"). Furthermore, they must meet one of these conditions:

  1. Be an employee (working for a company).
  2. Be self-employed (autónomo).
  3. Possess sufficient financial resources for themselves and their family members and hold a seguro de enfermedad público (public health insurance) or private insurance providing full coverage in Spain without co-payments.

Evidence of the link

It is imperative to present supporting documentation of the vínculo familiar (family tie). This includes marriage certificates, birth certificates, or partnership registrations, duly legalized or apostilled and, if necessary, translated by a sworn translator.

Goal: permanent residence

Meeting these requirements is the first step toward achieving permanent residence after five years, which grants total stability in Spanish territory, independent of the financial situation of the original Union citizen.

How to apply for the residence card?

The process to apply for the card must be initiated within 90 days of entering Spain. Here are the steps to manage the tarjeta de residencia:

Step 1: Preparing the official form

The first necessary document is the official form EX-19. This must be correctly completed and signed by the familiar de ciudadano (family member of the citizen).

Step 2: Payment of fees

Applicants must pay the relevant application tax, specifically Fee 790 code 012. The proof of payment is an essential requirement for the file to be admitted for processing.

Step 3: Submitting supporting documentation

The application for the familiar de ciudadano can be submitted electronically (with a digital certificate) or in person at the Immigration Office (Oficina de Extranjería). The documentación acreditativa must include:

  • The applicant's full passport.
  • The ID or registration certificate of the ciudadano de la unión.
  • Proof of the family relationship.
  • Proof of the financial solvency of the Union citizen.

How long is the card valid?

Once the issuance of the tarjeta de residencia is approved, the document has a five-year validity. This is the standard initial period for any family member establishing themselves for the first time.

During this periodo de residencia (residency period), the right to residencia en españa is maintained as long as the circumstances that gave rise to the right do not fundamentally change. At the end of these five years, the individual can apply for a permanent residence card. Note that the physical card is issued at a police station following a fingerprinting appointment.

How to renew the residence card?

Technically, after the first five years, we do not speak of a simple renewal, but of access to permanent status. The renewal of the card changes the legal nature of the permit.

Requirements for permanent status

To obtain the 10-year card, the familiar de ciudadano must prove they have resided continuously in Spain with the ciudadano comunitario for the previous five years. The documentación acreditativa usually includes the historical census certificate (empadronamiento) and proof that the family tie persists or that the right to maintain it has been earned (e.g., in cases of divorce after 3 years of marriage).

Renewal deadline

The renewal period for the tarjeta de residencia is 30 calendar days before the current card expires or up to 90 days after, though it is highly recommended to do so before it expires to avoid administrative hurdles.

What to do if the card is cancelled?

There are situations where the administration may consider that the derecho de residencia has been lost. If the immigration office notifies you that they have cancelled your permit, you must act quickly.

Common reasons for cancellation include:

  1. Prolonged absences from Spain (more than 6 months in a year).
  2. Cessation of the family tie (divorce or cancellation of de facto partnership) without meeting the requirements to retain the right.
  3. Hiding information or providing false documentation.

If the extinction of the tarjeta de residencia is notified, the familiar de ciudadano must submit new documentación acreditativa if they believe they are entitled to another type of residency. Maintaining the link with the ciudadano de la unión is key to defending your residency in Spain. When in doubt, an administrative appeal is the legal route to recover your status.

Tips for a successful application

To ensure your tarjeta de residencia de familiar de ciudadano de la unión is approved without delays:

  • Certificate Validity: Marriage or birth certificates should generally be no more than 3 to 6 months old at the time of application.
  • Census (Empadronamiento): Being registered at the same address is the strongest proof of a real family unit.
  • Health Insurance: Ensure your private insurance has no "copagos" (co-payments) or "carencia" (waiting periods), as this is a frequent cause for denial.

Obtaining this card is the bridge to an integrated life in the European Union, allowing not just residence, but full professional and personal development in Spain.

Key Takeaways

The tarjeta de residencia de familiar de ciudadano de la unión is more than just a permit; it is your gateway to a stable life within the European Union. By understanding the specific requirements, from proving financial solvency to demonstrating a valid vínculo familiar, you can navigate the application process with confidence.

While the administrative path may seem complex, following the steps outlined in this guide ensures that you protect your derecho de residencia and move toward long-term residencia permanente. Whether you are joining a spouse, partner, or parent, obtaining this card is the final hurdle to enjoying the full benefits of libre circulación and making Spain your permanent home. Be sure to keep your documentation updated, respect the plazo de renovación, and enjoy the journey of settling into your new life under the Spanish sun.
